USING MESSAGE BOARDS

You agree to use the message board facility on our site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the message board. Examples of prohibited behaviour include harassing or causing distress or inconvenience to any person or transmitting obscene or offensive content.

CONTRIBUTIONS AND COMMENTS

  • By posting any comment or sharing any contribution with us you agree to grant to us, free of charge, permission to use such material in any way we deem appropriate (including modifying and/or amending it for operational or editorial reasons.
  • Copyright in your contribution will remain with you, and the permission outlined above is not exclusive so you have the right to use such material in any way you choose.
  • By posting a comment or contributing any material to us you confirm that such material is your own work, is not defamatory, does not infringe the rights of any other person and does not contravene any UK laws. You also confirm that you have the right to give us the permission to use such material for the purposes outlined above.
  • We will not have any responsibility for the content, accuracy or opinions expressed in any comment or contribution, and we will not have any responsibility in relation to any links to third party sites included within any posted comment or contribution.

REGISTRATION

In order to post comments on the message board and use the full range of features available on our site, your child will be required to set up an account by registering with us as a member. Any personal information supplied to us as part of this registration process will be collected, stored and used in accordance with our Privacy Policy. You will be required to activate your child’s account by clicking on a link in an email sent by us to you.

MESSAGE BOARD RULES

By registering with us and by posting a comment or submitting any material to us you and your child agree to obey the following rules:

  • Remember not to post any personal information about you or anyone else, such as real names, addresses or telephone numbers in any of your messages.
  • Any comments must be polite and constructive: no comments should be mean-spirited or be posted with the intention of causing trouble or offence.
  • Remember that unlawful or objectionable content is not acceptable and we reserve the right to amend or remove comments or suspend member’s accounts if comments contain anything that is harassing, defamatory, abusive, threatening, harmful, obscene, profane, discriminatory, racially offensive or otherwise objectionable.
  • Please do not post the same comment more than once. We will not allow the submission of the same or very similar comments many times and we reserve the right to remove duplicate comments.
  • We will moderate the comments posted on to the website, but if you see a comment that contains anything that you think breaches these rules, please report this to us using the “flag” link next to the relevant comment. A message will be sent to the administrator who will then review the reported message. If deemed to be breaking the site’s rules (Darq Rules), we will remove the message.
  • If the message boards are used in any way that we, in our sole discretion, consider breaches these rules we reserve the right to immediately suspend your account and remove or refuse to post any comments and/or material.

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

LINKING TO OUR SITE

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice.

The majority of the messages posted on the message boards are created by the users of our site and the views expressed within the posts are theirs alone. We do not accept any responsibility for the contents of users’ posts on the message boards.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

JURISDICTION AND APPLICABLE LAW

If a dispute arises between you and us regarding your use of our site, then the English courts will have non-exclusive jurisdiction to hear such claim, although if you live outside of England and Wales, we retain the right to bring a claim against you in relation to your use of our site in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them shall be governed by the laws of England and Wales.
